Question by rbh101: what is the cost of professional liability insurance for an independent caregiver?
Location: California
Care provided is non-skilled/ custodial only.
The care receiver is my domestic partner.
Long term care policy says I must have professional liability insurance “to protect the care receiver from any injuries sustained due to care provided”.
Both our names are on our homeowners policy – which has a $ 2 M personal umbrella policy (apparently not adequate)

Personal umbrella, or homeowners, won’t cover any business pursuits – including professional liability. So it doesn’t matter WHAT the limit is, it’s not covered. Also, as you’re both named insureds, it won’t cover one of you, if the other one of you is being sued (or in your case, if your partner dies, and their child/parent/sibling/legal next of kin blood relative sues you on behalf of your partner’s estate), the homeowners and umbrella policy ALSO won’t protect you. So think about that.
What type of medical license do you have? If you aren’t at least an LPN, you’re not going to get the liability coverage. It’s basically medical malpractice. If you don’t have the LICENSE to practice, you can’t get the insurance, that covers if you mess up.
AND, you’ll also have to have general liability coverage (another business coverage). My guestimate on the cost for both of these is $ 2500 a year, assuming you’re the only employee.

When a patient visits a professional, that patient expects the professional to keep all information private and confidential. The patient is made to sign the HIPPA information and privacy forms at the beginning of treatment. The HIPPA laws in force protect that patient from unethical misuse of his or her information by the professional. The HIPPA disclosure also informs the patient how and when a person’s private information can be legally disclosed to third parties and what type of information can be disclosed.
This information is typically covered by patient client privilege as well; however, whether the professional does so on purpose or accidentally, sometimes, patient information is divulged to the wrong person or other privacy laws are violated. If this happens, it can result in damages to the patient including slander, libel and emotional stress for the patient. It can result in prison time, steep fines and revocation of the license to practice for the professional.
If a situation such as this were to happen, the mental health professional would need to defend him or herself against a claim. While the professionals employer may offer liability insurance protections as part of an overall benefits package or as part of the contract, this type of policy only defends the firm or the employer and not necessarily the mental health professional. For this reason, the professional should purchase a professional liability insurance policy that covers mental health professionals.
The private policy would also defend the professional first and not simply the firm or employer. This policy would cover any and all costs arising from a claim made against the professional regarding HIPPA violations including defense costs so the professional may fight to keep his or her license, loss of wages for time needed to defend the claim, and any malpractice settlements awarded the plaintiff of the claim brought against the mental health professional. While a typical liability insurance policy covers many items including pain and suffering, loss of wages, malpractice costs, medical costs, assault injuries, defense fees, settlement damages awarded a plaintiff and court costs, among other items, mental health professional liability insurance can cover much more and is worth the premium cost.
